Yesterday a judge in the Federal Court of Australia delivered a judgement on the Tickle vs Giggle case. Despite the strange name, this is a vitally important case because it affects women’s rights.
This case is that of a man who “identifies” as a woman who calls himself Roxy Tickle, feeling hurt because he was excluded from a women’s only app. Tickle took the CEO of Giggle the app, Sall Grover to court claiming discrimination.
In his ruling, Federal Court Justice Robert Bromwich said “sex is changeable”. He delivered his judgment finding Giggle guilty of indirect gender identity discrimination against Tickle, for refusing him admission to her female-only app. Sall Grover has been fined $10,000 and asked to pay $50,000 towards Tickle’s legal fees.
This was a very disappointing but unsurprising outcome as the judge said right from the beginning, he would be deciding the case based on what the law currently is, not what it should be. The unfortunate thing for women and girls in Australia is that our law gives more rights to men who identify as women, than to actual women and girls. We can thank our first and only female Prime Minister for contributing to this, Julia Gillard removed women as a category from the Sex Discrimination Act in 2013.
“The misogyny speech is not the only legacy of the Gillard’s government overreach. In the dying days of her government, legislation amending the Sex Discrimination Act 1984, the marquee act to eliminate discrimination against women in public life, was introduced and enacted. Largely unnoticed at the time, without critique or challenge, in the wake of the failed omnibus Human Rights and Anti-Discrimination Bill 2012, the Sex Discrimination Amendment (Sexual Orientation, Gender Identity and Intersex Status) Act 2013 passed. It was the Gillard government’s death rattle solution to assuage the demands of those in thrall to queer and gender theory activism, who scheme to denude law and policy of biological sex in favour of a self-declared gender identity.”

Last night on a Current Affair in Australia Sall Grover said “It has always been my intention to appeal to the highest place that I can. I’ve said I will go as far as I need to. I have a daughter. She’s two. I cannot send her out into the world where she has no rights. There is a next generation of little girls that we have to protect.”
Essentially what this means in Australia at the moment is that women cannot meet together (without the presence of men); if any men object to it!
That is ridiculous in 2024; Sall Grover has my support. This case may be about an app, however it is about way more than that. This case can change the future for Australian women.
